Learn the minimum requirements to form a society in India, including member count, age, nationality, address proof, and document criteria.
If you’re planning to start a non-profit or charitable organization in India, Society Registration is a popular and legally recognized option under the Societies Registration Act, 1860. However, before applying for registration, it is essential to understand the minimum legal requirements regarding the members, documents, and compliance conditions. This guide covers everything you need to know before forming a society in India.
To apply for Society Registration, a minimum of seven members is required. These members are considered the founding members and must sign the Memorandum of Association (MoA) at the time of incorporation.
If you are forming a society with a national-level operation or international focus, the requirement may be higher. For example, eight members from different states may be needed for national-level societies, depending on the registrar’s office in your state.
The following types of individuals and entities can become members of a society: Indian citizens aged 18 years or older, foreign nationals (in most states, but at least one Indian resident is mandatory), companies or registered firms, and other registered societies or institutions. Each member must submit ID proof and address proof along with passport-size photographs at the time of Society Registration.
All members must be at least 18 years old. At least one member must be a resident Indian citizen. In some states, more than 50% of the founding members must be Indian nationals.
A registered address is mandatory for completing Society Registration. This address will be used for all official communications. You need to submit one or more of the following: electricity bill or water bill (not older than 2 months), rent agreement with No Objection Certificate (NOC) from the landlord, or property tax receipt or ownership document (if premises are owned).
Choosing a name for your society is an important step. The name should not resemble any already registered society, not contain words like Government, National, or India unless prior approval is taken, and not violate provisions of the Emblems and Names (Prevention of Improper Use) Act, 1950.
Each founding member should submit PAN card or Aadhaar card, address proof (Voter ID, Passport, or Utility Bill), passport-size photo, and signature on the MoA and Rules & Regulations document.
Before starting the Society Registration process, you must prepare the Memorandum of Association (MoA) outlining the name, objectives, and details of the members, and the Rules and Regulations that will govern the functioning of the society. Both documents must be signed by all founding members and submitted with the registration form.
Forming a society in India is a straightforward legal process, but it requires compliance with all eligibility conditions. Ensuring the minimum number of members, valid ID and address proof, age requirements, and a proper registered office address can help avoid delays. Whether your focus is on education, culture, or health, meeting these basic conditions is the first step toward successful Society Registration.
